Areas of Practice
Robert E.
Warner joined Bays, Deaver, Lung, Rose & Holma in
January 2006 as Of Counsel. His practice focuses on
condominiums, time shares and other residential, resort
and commercial development, and real estate,
construction, and corporate and general business law.
Mr. Warner has been a
practicing attorney in Hawaii since 1970, principally
assisting real estate developers such as Boise Cascade
in its Waikoloa development in the 1970’s, James K.
Schuler in the late ‘70s and 1980’s, and various time
share developers acquiring , building or converting
condominiums to time share use, including Fairfield
Resorts, one of the largest time share developers and
operators in the world.
Mr. Warner has worked on a
range of condominiums from Canterbury Place and other
Waikiki projects, to numerous resort projects on all of
the outer islands (except Molokai), and residential
projects on Oahu and the Big Island. Representative
projects include:
Condominiums -
Canterbury Place, Waikiki (1974-77), a sub-leasehold
resort development; Cliffside Villages and Waipio
Villages, Waipo, Oahu (1982-88), owner-occupant phased
residential condominiums with an affordable house
component developed within the Gentry Homes master
development; Laule’a, Kihei, Maui (1982-85), a fee
simple resort condominium now the location of the Maui
Schooner Time Share; Pono Kai, Kapaa, Kaui (1979-82);
Maui Islander, Lahaina, Maui, a Bishop Estate leasehold
property operated as a condotel (1978-80).
Shopping Centers and
other Commercial Properties - Pearl Ridge Shopping
Center, Phases 1, 2 & 3, Pearl Ridge, Oahu (1970-1977),
on Bishop Estate land, representing developer on master
planning, entitlements & permitting, major tenant
leasing and reciprocal easement agreements, construction
and takeout financing, construction disputes, mechanic’s
liens and related litigation, minor tenant leasing.
Master
Developments/Subdivisions - Waikoloa Village &
Resort, Waikoloa, Hawaii (1974-1977), representing
original developer Boise Cascade on state & federal
subdivision registrations and exemptions, master
planning, entitlements & permitting; community, public
and home owner relations and bulk land sales to “retail”
developers; Lokahi Makai Subdivision, Kailua, Kona
(2003-Present).
